These Terms of Service govern your use of eCureTrip's platform and services. By using our website or services, you agree to these terms. Please read them carefully.

1. Service Description

eCureTrip is a medical tourism coordination platform. We connect international patients with healthcare providers in India. We do not provide medical care ourselves.

Services include:

  • Expert Opinion: Coordination of a specialist-led review of your diagnosis, reports, and treatment options by an oncologist or relevant specialist from our network
  • Tumor Board Consultation: Coordination of a multidisciplinary review where specialists (e.g. medical, surgical, radiation oncology) discuss your case and provide a consensus recommendation
  • Medical Value Travel: End-to-end coordination including treatment planning, hospital and doctor referrals, cost estimation (including our Twin-Engine and Clinical Blueprint tools where applicable), teleconsultation scheduling, and travel support

Medical coordination includes:

  • Doctor and hospital referrals
  • Treatment planning and scheduling
  • Medical record coordination and case workflow (intake, document upload, imaging review support)
  • Follow-up care coordination

Travel support includes:

  • Visa and documentation assistance
  • Accommodation and transportation coordination
  • Airport pickup and local guidance
  • Support for you and your attendant during your stay

2. Eligibility and Age Requirement

Our services are intended for individuals aged 18 years and above. By using our services, you confirm that you are at least 18 years of age.

For patients under 18 years of age, a parent or legal guardian must:

  • Provide verifiable consent for data collection and processing
  • Manage all engagement and communication with eCureTrip on behalf of the minor
  • Accept these Terms of Service on behalf of the minor

3. User Responsibilities

  • You must provide accurate and complete medical and personal information so we can coordinate your care safely and effectively.
  • All medical decisions are between you and your healthcare providers. eCureTrip facilitates connections and coordination only; we do not provide medical advice, diagnosis, or treatment.
  • You must comply with applicable laws, including those of your home country and India, and with the requirements of the healthcare providers you engage.
  • You are responsible for maintaining the confidentiality of any account credentials or access links provided to you.
  • You must not upload malicious files, use the platform for unlawful purposes, or share your access credentials with unauthorised individuals.

4. Medical Disclaimer

eCureTrip is not a healthcare provider. We are a coordination service. Information on our platform (including cost ranges, treatment pathways, and general descriptions) is for informational purposes only and does not constitute medical advice, diagnosis, or treatment.

All medical care, treatment decisions, and outcomes are the sole responsibility of the licensed healthcare providers you choose. eCureTrip does not guarantee any particular medical result.

In a medical emergency, contact local emergency services immediately. Do not rely on our platform for emergency medical assistance.

5. Teleconsultation Terms

eCureTrip may facilitate video consultations between you and healthcare providers using third-party platforms (e.g. Zoom, or similar services). By participating in a teleconsultation:

  • Recording: Video consultations may be recorded with your explicit consent for clinical documentation, second opinion purposes, and quality assurance. You will be informed before any recording begins, and your consent will be obtained. You may decline recording.
  • Limitations: Virtual consultations do not replace in-person examination where clinically required. The consulting doctor will advise if an in-person visit is necessary.
  • Technical issues: eCureTrip is not liable for call drops, audio/video quality issues, or connectivity failures during teleconsultations. If a session is disrupted, we will work to reschedule at no additional cost.
  • Privacy: Teleconsultations are conducted on encrypted, secure platforms. However, you are responsible for ensuring privacy at your end (e.g. conducting the call in a private setting).
  • No emergency use: Teleconsultations are scheduled appointments and are not a substitute for emergency medical care.

6. Cross-Border Data Transfer

By using our services, you acknowledge and consent to the following:

  • Your personal and medical data will be transferred from your country of residence to India for the purpose of care coordination
  • Your data may be shared with healthcare providers, hospitals, and specialists in India as part of the services you have engaged
  • Different countries may have different data protection standards. We apply appropriate safeguards to protect your data during transfer, including encryption, access controls, and contractual obligations on data recipients
  • You have the right to withdraw this consent at any time by contacting us at contact@ecuretrip.com

For patients in the EEA/UK, transfers are subject to Standard Contractual Clauses or equivalent mechanisms as required by GDPR.

7. Service Limitations

  • We strive to maintain platform availability but do not guarantee uninterrupted access.
  • We may use third-party services (e.g. hosting, payments, teleconsultation). We are not responsible for their availability, content, or practices.
  • Our services are focused on medical tourism to India. Availability may vary by your location, diagnosis, and the providers in our network.
  • Estimated costs provided through our platform are indicative and may vary based on the treating hospital's assessment.

8. Payment and Refunds

eCureTrip charges fees for our coordination services. Treatment costs are separate and paid to the healthcare providers or hospitals as agreed with them. Our fees and payment terms will be communicated at the time of engagement.

Refunds for our coordination services are subject to our refund policy as communicated to you. Refunds for medical treatment are handled by the relevant healthcare providers.

We use secure, encrypted payment channels. Your payment information is processed in accordance with our Privacy Policy and applicable payment regulations.

9. Intellectual Property

  • The eCureTrip platform, brand, logo, Clinical Blueprint reports, Twin-Engine cost estimation tools, and all related content, software, and documentation are the intellectual property of eCureTrip HealthTech Pvt. Ltd.
  • Clinical Blueprints and reports generated for your case are provided for your personal medical use and for sharing with your healthcare providers. They may not be reproduced, distributed, or used for commercial purposes without our written consent.
  • Medical records, reports, and documents you upload remain your property. By uploading, you grant eCureTrip a limited licence to use them solely for the purpose of coordinating your care.

10. Limitation of Liability

To the fullest extent permitted by law:

  • eCureTrip is not liable for medical outcomes, treatment results, or the actions or omissions of healthcare providers.
  • Our total liability for claims arising from our coordination services is limited to the amount you have paid to eCureTrip for those services in the twelve (12) months preceding the claim.
  • We are not responsible for travel delays, cancellations, visa refusals, or other travel-related issues beyond our control.
  • We do not guarantee specific medical outcomes, success of treatment, or availability of any particular provider or hospital.
  • We are not liable for any loss or damage arising from teleconsultation technical failures.

Some jurisdictions do not allow certain limitations of liability; in such cases, our liability is limited to the maximum extent permitted by law.

11. Indemnification

You agree to indemnify and hold harmless eCureTrip HealthTech Pvt. Ltd., its directors, employees, and agents from any claims, losses, damages, liabilities, and expenses (including legal fees) arising from:

  • Your provision of inaccurate or incomplete medical or personal information
  • Your violation of these Terms of Service
  • Your misuse of the platform or services
  • Any third-party claims related to your use of our services

12. Force Majeure

eCureTrip shall not be liable for any failure or delay in performing our obligations where such failure or delay results from events beyond our reasonable control, including but not limited to:

  • Natural disasters, pandemics, or epidemics
  • War, terrorism, civil unrest, or government actions
  • Strikes, labour disputes, or supply chain disruptions
  • Internet or telecommunications failures
  • Changes in applicable laws or regulations

In such events, we will make reasonable efforts to resume services as soon as practicable and will communicate with affected users about any impact on their ongoing cases.

13. Account Termination

eCureTrip reserves the right to suspend or terminate your access to the platform if:

  • You violate these Terms of Service
  • You provide materially false or misleading information
  • Your use of the platform poses a security risk or legal liability
  • Required by law or regulatory authority

Upon termination:

  • We will notify you via email with the reason for termination
  • Your personal data will be handled in accordance with our Privacy Policy and data retention schedule
  • You may request a copy of your data before termination takes effect, where feasible

14. Dispute Resolution

In the event of any dispute arising from these terms or your use of our services:

  1. Informal Resolution: You agree to first contact us at contact@ecuretrip.com and attempt to resolve the dispute informally within 30 days.
  2. Mediation: If the dispute is not resolved informally, either party may refer it to mediation under the rules of the Indian Council of Arbitration or a mutually agreed mediator.
  3. Jurisdiction: If mediation fails, the dispute shall be subject to the exclusive jurisdiction of the courts in Ahmedabad, Gujarat, India.

These terms are governed by the laws of India.

15. Privacy and Data Protection

Our collection, use, and protection of your personal and medical information is described in our Privacy Policy. By using our services, you consent to such processing in accordance with that policy, the Digital Personal Data Protection Act, 2023 (India), and applicable data protection laws.

16. Changes to These Terms

We may update these Terms of Service from time to time. When we make material changes:

  • We will update the "Last updated" date at the top of this page
  • We will notify you via email or through our platform at least 30 days before material changes take effect
  • Continued use of our services after notification constitutes acceptance of the updated terms

If you do not agree with the updated terms, you may discontinue use of our services and request deletion of your data.
